PARTICIPATION AGREEMENT
Assumption of Risk, Waiver of Liability, Release and Indemnification
THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
PLEASE READ CAREFULLY BEFORE AGREEING.
If the Participant is under 18 years old, a parent or legal guardian must also read and agree to this Agreement.
This Participation Agreement (Assumption of Risk, Waiver of Liability, Release and Indemnification) (“Agreement”) is entered into between CRCC Asia Limited, a company incorporated in Hong Kong with registered number 1289657 and having its registered office at Rooms 1318-20, 13/F Hollywood Plaza, 610 Nathan Road, Mongkok, Hong Kong (“CRCC”, “We”, “Us”, or “Our”), and the individual whose name and address appear in the signature line below (“Participant”, “You”, or “Your”).
BACKGROUND
This Agreement is intended to govern the relationship between CRCC and Participant with respect to Participant’s participation in the international program offered by CRCC and noted below (“Program”). In consideration for being permitted to participate in the Program, CRCC requires that You carefully review the provisions of this Agreement. By signing this Agreement in the space provided below, You acknowledge and agree to the following:
AGREEMENT
1. The Purpose of CRCC Programs
CRCC Programs are an opportunity to gain work experience, training and/or professional skills in one of CRCC’s program locations around the world. It is an investment in Your future and is not a holiday or tourist service. We ask that You manage Your expectations accordingly before embarking on one of Our programs. You confirm that You are committed to completing the Program and will do so to the best of Your abilities.
For those registered under the International Experiences Program, the focus is on short-term cultural excursions that enrich cultural awareness and personal growth. While the activities may differ from those in internship-based or professional training programs, participants are expected to fully engage in scheduled activities and uphold CRCC's standards of conduct. As with all CRCC offerings, the International Experiences Program is not a holiday or tourist service.
2. Application Process and Deposit; Non-Discrimination
In order to be accepted onto the Program, You must complete Our application process and be offered a place on the Program. Your place on the Program will be reserved once We receive a deposit (the “Acceptance Fee”) from You (if You are a Self-paying Participant), or from our University Partners (if You are a University-paying Participant) in the amount specified in your acceptance letter or Our initial invoice. The Acceptance Fee is non-refundable unless the Program has been cancelled by Us without the Participant’s consent or a refund of the Acceptance Fee is decided upon by Us at Our discretion (see “Changes, Extensions and Cancellations” and ”Changes and Cancellations by Us” sections below). This is due to the fact that We will start work in relation to Your participation in the Program as soon as We receive the Acceptance Fee.
We retain the right to reject any application We deem unsuitable for the Program, in Our sole discretion and at any stage of the application process. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender, age, national origin, citizenship, disability, pregnancy, veteran status, or any other legally protected characteristic, and We do not reject applications based on any of these criteria.
3. What’s included in the Program?
Your Program includes the specific services set out in the applicable program description and selected by You in Your application materials (“Services”). Your applicable Program Type and included Services will be provided in Your Offer Letter. We undertake to provide the Services, subject to the terms and conditions of this Agreement. We reserve the right to make reasonable changes to, or substitutions for, the Services due to local conditions or other factors, provided that such changes do not materially reduce the overall nature of the Program.
Program inclusions vary by Program Type. Not all Services listed below apply to every Program.
3.1. Program Types & High-Level Inclusions:
3.2.1. Full Internship Programs
Full Internship Programs typically include:
a. An unpaid internship placement with a Host Company
b. Accommodation for the duration of the Program
c. Airport pick-up at designated airport, dates and times
d. Orientation activities
e. Welcome Pack on arrival
f. Access to CareerBridge, our professional development hub (including online professional development courses)
g. In-country support during the Program
h. On-site emergency support
i. Monthly business, cultural and community events
j. Access to CRCC’s Alumni Network and alumni communication channels
3.2.2. Placement Only Programs
Placement Only Programs are limited in scope and typically include:
a. An unpaid internship placement with a Host Company
b. Access to CareerBridge, our professional development hub
c. Pre-arrival information and placement-related support
d. Access to CRCC’s Alumni Network and alumni communication channels
Placement Only Programs do not include accommodation, airport pick-up, orientation activities, welcome packs, on-site emergency support, or monthly events unless explicitly stated otherwise in writing as part of a customized arrangement.
3.2.3. International Experiences Programs
International Experiences Programs typically include a combination of experiential, cultural, and professional elements, which may include:
a. Structured program activities or project-based experiences
b. Orientation activities
c. Welcome Pack on arrival
d. In-country support during scheduled program activities
e. Access to CRCC’s Alumni Network
The exact Services included depend on the specific International Experience selected and will be confirmed in the applicable program description.
3.2.4. University Custom Programs
University Custom Programs are designed in partnership with academic institutions. Services included are defined by the agreed program scope and may include some or all of the Services listed above.
Only the Services explicitly agreed in writing with the partner institution are included. Any additional services are excluded unless expressly stated.
3.2. Additional Notes on Services
3.2.1. Emergency Support: On-site emergency support is provided only for Program Types where it is explicitly included (e.g. Full Internship Programs). It is not included in standard Placement Only Programs.
3.2.2. CareerBridge: Where included, participants receive access to CareerBridge, which contains professional development content and online courses.
3.2.3. Orientation & Welcome Activities: Orientation sessions, city tours, and welcome items vary by location and Program Type.
3.2.4. Alumni Network: Where included, access is provided upon Program completion.
3.2.5. Placement Disclaimer: Where a Placement is included, we will arrange an unpaid placement with a Host Company. While CRCC endeavours to ensure a high standard of service and provides reasonable support, we do not control the specific tasks, duties, supervision style, or workload assigned by the Host Company.
3.2.6. Accommodation, Airport Pick-Up, and Other Services: Accommodation, airport pick-up, cultural activities, language classes, and other supplementary services are provided only where explicitly included in Your selected Program and confirmed in Your program documentation.
4. Notification of Placement
4.1. We will notify you of your Host Company in writing before your Program Start Date. The Placement timeline varies for each Participant, and we will endeavor to provide you with updates during the Placement process and if a Placement notification is delayed.
4.2. Prior to sending a Placement notification to You, if we arrange an interview with a Host Company, we expect You to respond to the interview request promptly, act professionally, and complete the interview to the best of Your ability. If You complete an interview and are not accepted into the Host Company, we will arrange another interview. An invitation to interview with a Host Company does not assure Placement within either the Host Company or the sector. Please note that in some cases, a Host Company can offer you a Placement without an interview.
4.3. We will ensure that Your Placement falls within one of Your pre-specified three (3) career fields of Your choice and/or the role offered relates to those three (3) career fields, what showed in Your application materials, or Your interests mentioned in the Advising calls. We do not guarantee a specific company, role, or sector, other than Your pre-specified career fields of choice. All three (3) career fields You have specified are considered equally important during the Placement Process, and we can place You in any of the career fields You chose.
4.4. If, for whatever reason, You do not accept the Placement, and it falls within Your three (3) career fields of Your choice as indicated in your application materials, and/or the role offered relates to those three (3) career fields, or Your interests mentioned in the Advising call, and You choose not to participate in the Program, we will give no refund of program fees or any other associated costs, and we will not be obliged to provide an alternative Placement.If, despite the Participant’s good-faith participation in the Placement process (including timely responses, professional conduct, and reasonable interview performance), We are unable to secure a Placement for the Participant within one (1) of the three (3) selected career fields by (1) week after the Program Start Date, We may, at Our discretion:
(a) offer a deferred placement to a later intake; or(b) offer a partial refund of Program fees, excluding non-refundable administrative, third-party, or already-incurred costs.
4.5. You agree that until your placement in the Internship Program is officially confirmed by Us, You shall not initiate any direct contact with Host Companies regarding the placement, program details, or related matters. Failure to comply with this requirement may result in delay or withdrawal of placement support.Should You receive any unsolicited direct communication from a Host Company, or if You have inadvertently engaged in direct contact with a Host Company prior to official confirmation, You must immediately notify Us.
5. Visas and Passports
5.1. You are solely responsible for holding a valid passport and obtaining any visa, permit, or other authorization required to participate in Your Program and to enter, remain in, and depart from the Program location.
5.2. Visa requirements vary by Program Type and location. For certain Program locations, CRCC may be required to provide support in the visa application process as part of program delivery. In such cases, CRCC will provide reasonable assistance in accordance with the applicable Program description. However, CRCC does not guarantee visa approval and accepts no liability for the outcome of any visa application, which remains subject to the sole discretion of the relevant authorities.
5.3. Where visa services are not explicitly included or required as part of Your Program, You are responsible for researching, applying for, and securing the appropriate visa. CRCC may provide general guidance or documentation where reasonably possible, but such support does not constitute visa advice or visa processing services.
5.4. CRCC shall not be responsible or liable for any loss of, damage to, or costs relating to Your passport or other personal property at any stage of the visa process, during transit, during the Program, or during registration with authorities or other third parties.
5.5. If Your visa is delayed, denied, or not issued prior to the Program Start Date, CRCC shall not be responsible for any costs incurred by You, including but not limited to flight change fees or other travel-related expenses.
5.6. It is Your responsibility to confirm whether visa services are included in Your Program and whether any visa-related fees are covered, as this varies by Program Type. You must comply with all immigration laws, visa conditions, and requirements imposed by the host country, Host Company, or relevant authorities.
5.7. You acknowledge that You may be required to provide copies of Your passport, visa, and supporting documentation to CRCC or the Host Company as a condition of participation.
5.8. Programs Requiring CRCC Visa Support
For certain Program locations, CRCC will provide visa-related support as required by the Program. Where such support is provided:
5.8.1. CRCC will use reasonable efforts to assist You with the visa application process;
5.8.2. You must fully cooperate and provide all requested documents within the specified timelines;
5.8.3. CRCC does not guarantee visa approval and is not responsible for refusals, delays, or conditions imposed by immigration authorities;
5.8.4. No refund of Program or visa-related fees will be provided in the event of visa refusal or delay.
5.9. Programs Without CRCC Visa Services
Where visa services are not included or required as part of Your Program:
5.9.1. You are responsible for independently obtaining the appropriate visa;
5.9.2. CRCC may, where possible, provide general information or documentation that we have available;
5.9.3. Failure to obtain the correct visa or to inform CRCC of visa outcomes in a timely manner may result in cancellation of Your participation, with no refund of Program fees.
5.10. Visa Timelines (Where CRCC Support Is Provided)
Where Your Program includes visa assistance:
5.10.1. Participation and visa support must be confirmed at least twelve (12) weeks prior to the Program Start Date, unless otherwise specified;
5.10.2. All required visa documentation must be submitted at least ten (10) weeks prior to the Program Start Date, unless otherwise specified.
5.10.3. Failure to meet these timelines may result in visa refusal or delay, for which CRCC bears no responsibility.
5.11. Additional Visa-Related Terms
5.11.1. Visa fees, government charges, courier fees, and third-party costs are Your responsibility unless expressly stated otherwise.
5.11.2. You are responsible for checking the accuracy and validity of any visa issued.
5.11.3. Travel outside the Program location requires appropriate visa permissions.
5.11.4. Remaining in the Program location beyond the Program End Date is Your responsibility and requires a valid visa.
5.11.5. If You are issued a visa that does not permit participation in the Program, CRCC may, where reasonably possible, work with You to identify an alternative solution, which may involve additional costs.
6. Insurance and Travel Arrangements
6.1. Insurance
6.1.1. You are responsible for ensuring that You have purchased full, comprehensive insurance prior to Your Program start date which will adequately cover You for the duration of Your Program.
6.1.2. Your insurance should include repatriation, cancellation, travel, health, medical (including pre-existing medical conditions) and personal liability insurance.
6.1.3. You must provide us with all relevant details about Your travel insurance policy.
6.1.4. You must bring all relevant insurance documents with You to the Program location.
6.1.5. Neither we nor our employees are liable for any medical advice given by ourselves or third parties.
6.1.6. It is Your responsibility to claim any expenses directly from Your insurance provider. We will offer You reasonable assistance to complete forms where we deem it appropriate but we cannot be held liable for any financial loss You encounter in relation to the accuracy of Our assistance.
6.1.7. If You choose to travel without adequate insurance cover, we will not be liable for any losses howsoever arising in respect of which insurance cover would otherwise have been available.
6.2. Flights
6.2.1. Flights are not included in any of CRCC’s programs.
6.2.2. You must purchase Your own flight tickets to arrive in the Program location by Your Program Start Date. Your purchase of the flight tickets should not be dependent on any other services that are being provided (e.g: the Placement), and no refund will be made in the case You do not purchase your flight tickets in time for the Program.
6.2.3. If You wish to use our airport pick-up service and this service is included in Your Program, You are responsible for any travel costs related to traveling to our specified airport as stipulated in Your Welcome Pack.
6.2.4. We are not responsible for any damages or costs due to any act, omission or negligence relating to the purchase of flight tickets or the operation of flights or any other form of transport.
6.2.5. We are not responsible for any costs You incur due to changes or delays in flights, trains or any other form of transport.
7. Code of Conduct
7.1. You agree to behave in a respectful, courteous, and professional manner at all times during your Program, including in your interactions with CRCC Asia staff, Program staff, fellow participants, Host Company representatives and colleagues, accommodation providers, and members of the general public. As a guest in a foreign culture, you agree to be sensitive and respectful toward people of all races, ethnicities, nationalities, religious beliefs, cultural backgrounds, and traditions.
7.2. Bullying, harassment (including sexual harassment), abuse, antisocial or unreasonable behaviour, excessive absence from work, excessive intoxication, or the use or possession of illegal drugs will not be tolerated.
7.3. Drugs and Alcohol
7.3.1. You are responsible for exercising good judgment when consuming alcohol and ensuring that you do not become intoxicated. If you choose to consume alcohol during your Program, you must do so responsibly and within your personal limits.
7.3.2. CRCC Asia enforces a zero-tolerance policy on illegal drugs. The possession, use, distribution, or involvement with illegal drugs is strictly prohibited. Any Participant found in breach of this policy may be immediately removed from the Program and accommodation.
7.3.3. You must comply with all laws and regulations relating to drugs, alcohol, and controlled substances in your Program location.
7.4. Professional Conduct During Your Internship or Training
7.4.1. As an intern or trainee, you represent CRCC Asia, your university (if applicable), and your home country. You are expected to behave professionally at all times in a real working environment.
7.4.2. You must adhere to your Host Company’s rules, policies, and cultural standards, including punctuality, attendance, task completion, and respectful communication.
7.4.3. Harassment, abuse, or discourtesy toward Host Company staff, CRCC Asia staff, or fellow participants will not be tolerated.
7.4.4. Absences from work for two (2) consecutive days require a valid medical certificate. CRCC Asia staff are available to assist in emergencies but are not medical or translation professionals and cannot advise on medical procedures.
7.4.5. Upon completion or termination of the Program, You must promptly return all Host Company property, documents, materials, equipment, access credentials, and any other items provided to You in connection with Your Placement, whether in physical or electronic form, unless otherwise agreed in writing by the Host Company.
7.4.6. Your Host Company reserves the right to dismiss you from your internship. If this occurs, CRCC Asia is not obligated to secure an alternative placement, and you may be required to leave the Program and accommodation.
7.4.7. CRCC Asia Program Managers are available to support you with workplace issues; however, you must communicate openly and promptly for assistance to be effective. Failure to maintain respectful communication with CRCC Asia staff may result in removal from the Program and accommodation.
7.4.8. Requests to change Host Companies must be submitted via the designated Host Company Change Form. Requests will only be considered where reasons are genuine and reasonable.
7.4.9. You agree to complete all required feedback and evaluation forms provided during or at the end of your internship or training, as feedback is essential for Program quality assurance.
7.5. Program Participation and Cooperation
7.5.1. You agree to cooperate fully with CRCC Asia before and during your Program, including:
a. Actively working with your assigned CRCC representatives;
b. Participating in scheduled interviews;
c. Responding to CRCC communications within 2–3 business days, unless otherwise specified or in urgent situations;
d. Meeting agreed payment deadlines;
e. Accepting internships offered within or related to one of your top three (3) selected career fields;
f. Acting honestly and with integrity at all times.
7.5.2. You confirm that your Program is strictly unpaid and short-term (under three (3) months) unless otherwise stated, and you will not engage in other work in the Program location except as permitted under this Agreement and local law.
7.5.3. Participants who, in the sole judgment of CRCC Asia, fail to cooperate in good faith may be removed from the Program without refund.
7.5.4. Participants who fail to settle the final installment of the Program fees by the agreed payment deadline may, at the sole discretion of CRCC Asia, be prohibited from commencing the Program and, where included, denied access to accommodation.
7.6. Accommodation Rules
7.6.1. You must comply with all accommodation rules provided by CRCC Asia or accommodation partners.
7.6.2. Certain accommodations may require the payment of a refundable security or rental deposit prior to or upon check-in. The deposit is intended to cover damage, excessive cleaning, unpaid utilities, lost keys or access cards, or other breaches of accommodation rules. The release, timing, and amount of any deposit refund are subject to inspection by the accommodation provider and their applicable policies. Deductions, if any, may be made in accordance with those policies, and refunds are not guaranteed in the event of rule violations or outstanding charges.
7.6.3. Damage to accommodation property must be paid for within twenty-four (24) hours by the responsible Participant(s). Failure to do so may result in removal from the accommodation and/or Program.
7.6.4. Overnight guests are not permitted unless explicitly authorised.
7.6.5. Illegal activities, weapons, gambling, vandalism, disturbances, smoking in non-designated areas, or unsafe behaviour are strictly prohibited.
7.6.6. You are responsible for respecting shared living arrangements, including cleanliness, noise levels, privacy, and cultural differences. Roommate changes are not permitted except in exceptional circumstances as determined by CRCC Asia.
7.6.7. Excessive utility usage beyond the included allowance may result in deductions from your deposit.
7.7. Behaviour, Safety, and Liability
7.7.1. You are responsible for your own safety at all times during the Program. CRCC Asia strongly advises against the use of personal vehicles, motorcycles, or motorcycle taxis.
7.7.2. You must comply with all local laws and regulations of your Program location. Criminal behaviour may result in severe penalties, even if such conduct may be treated differently in your home country.
7.7.3. CRCC Asia reserves the right to remove any Participant who:
a. Breaches this Code of Conduct;
b. Violates Host Company or accommodation rules;
c. Engages in harassment, bullying, or criminal behaviour;
d. Fails to meet attendance or participation requirements.
7.7.4. CRCC Asia is not responsible for third-party actions, accidents occurring at third-party locations, or damages caused by Participants to Host Companies or accommodation providers.
7.7.5. You shall be responsible for any loss of, damage to, or misuse of Host Company property caused by You during the Program. Where such loss or damage occurs, You agree to reimburse the Host Company for the reasonable costs of repair or replacement, as determined by the Host Company. CRCC Asia shall not be responsible for such reimbursement but may, where appropriate, facilitate communication between You and the Host Company.
7.8. Failure to comply with this Code of Conduct may result in disciplinary action, including warnings, removal from the Program, removal from accommodation, or termination of participation without refund, at the sole discretion of CRCC Asia.
8. Termination
9.1. CRCC may terminate this Agreement immediately upon written notice to You should You fail to comply with any of the terms and conditions contained herein. No refund will be granted to You and You will be required to leave the designated accommodation within two (2) days of being informed by Us in writing to do so.
9.2. If the Host Company terminates a Participant’s Placement prior to the Program End Date as a result of the Participant’s inadequate or unhelpful participation, prolonged or repeated absence from work, repeated tardiness in arrival at work, or for any other reason attributable to the behavior of the Participant, CRCC may terminate this Agreement immediately, no refund of Program fees will be given, and We are under no obligation to provide another placement. In such a case, the Participant will be required to leave the designated accommodation within two (2) days of being informed by Us in writing to do so.
9. Changes, Extensions and Cancellations
9.1. Changing the dates of Your Program
Unless previously agreed to by us in writing, if You want to change the dates of Your Program, we will grant this request at our sole discretion and reserve the right to refuse Your request or apply an additional reasonable charge.
9.2. Changing Your Program to Another Program
Unless previously agreed to by Us in writing, if You want to change to another Program, we will grant this request at our sole discretion and reserve the right to refuse Your request or apply an additional reasonable charge. A request to change Your Program to another one of our programs must be made at least twelve (12) weeks prior to Your Program Start Date.
9.3. Extending Your Program
You may be able to extend Your Program but if You want to extend Your Program once You have started Your Program, You will be charged our applicable Program extension fees and/or the applicable Program Fee, details of which can be obtained from Your local CRCC office.
9.4. Discontinuing Your Program
If You decide to discontinue Your Program prior to the Program End Date for any reason, You must provide us with written notice prior to discontinuation, clearly stating the reasons for Your decision. No refund of Program fees will be made in this situation, no other placement will be offered, and You will be required to leave the designated accommodation within two (2) days of being informed by us in writing to do so.
9.5. Cancellations by You
9.5.1. If you wish to cancel your place on your Program, either prior to the Program Start Date or after the Program Start Date, you must send a written cancellation request to the CRCC office handling your Program, or to the university department coordinating Your Program (in the case of university-sponsored programs). In such a situation no other placement will be offered by CRCC, and you will be required to leave the designated accommodation within two (2) days of being informed by us in writing to do so.
9.5.2. Unless otherwise agreed in writing between CRCC and You (or your university), any refund of Program fees and/or deposits will be assessed at Our sole discretion. Where approved, refunds shall be limited to amounts actually paid, excluding the non-refundable deposit of US$500 and any costs that are non-recoverable or have already been incurred.Refund requests will be considered only in the following extenuating circumstances:
a. Serious illness – If You are unable to participate on the Program due to a serious illness, We require documentary evidence from a licensed doctor confirming that on medical grounds you are advised not to participate in Your Program. This documentation must be provided before the program start date.
b. Death of an immediate family member – In the case of bereavement of an immediate family member within twenty-eight (28) days of Your Program start date, We may require, at Our discretion, documentary evidence to verify the bereavement, this can include: (i) death certificate; (ii) a letter outlining full name of deceased, relationship to You, location and date of death, and Your signature. For the purposes of this Agreement, We consider the following members as “immediate” family members: (A) spouse; (B) civil partner; (C) children (including adopted/step children); (D) parents (including step parents); (E) siblings (including step siblings); (F) grandparents and grandchildren; (G) siblings-in-law; and (H) children-in-law.
9.6. Changes and Cancellations by Us
9.6.1. If we have to cancel Your Program prior to the Program Start Date for reasons which are in no way attributable to You and You have paid the Program fee in full, we will endeavor to find You a suitable alternative Program or will offer You a refund of all fees received by Us from You for Your Program.
9.6.2. Program Variations. We reserve the right to change our suppliers and the format of our programs as and when necessary at our discretion and without requiring Your consent. We will, however, endeavor to provide as similar a Program as possible at all times.
10. Refund Information and Protocol
You acknowledge that all fees, charges, costs, deposits, and other financial considerations paid to CRCC Asia, to Your respective University/Educational Institution, or to Your Service Provider (collectively, the "Program Provider") in connection with the Internship Program or International Experiences Program are subject to the following refund policy:
10.1. Refund Eligibility and Refundable Fees
10.1.1. Cancellation requests must be submitted in writing to both the applicable Program Provider and CRCC Asia.
10.1.2. If You cancel or withdraw more than twelve (12) weeks prior to the applicable Program start date, CRCC Asia, in conjunction with the relevant Program Provider, shall retain a non-refundable administrative fee of $500, and a full refund of the remaining applicable Program Fees will be issued.
10.1.3. If You cancel or withdraw more than eight (8) weeks but less than twelve (12) weeks prior to the applicable Program start date, CRCC Asia, in conjunction with the relevant Program Provider, shall retain a non-refundable administrative fee of $500 and refund fifty percent (50%) of the remaining applicable Program Fees.
10.1.4. If You cancel or withdraw less than eight (8) weeks prior to the applicable Program start date, no refund shall be provided, and the entire payment shall be forfeited.
10.1.5. Notwithstanding the foregoing, specific Program Providers may offer special cancellation timelines and arrangements, which will be communicated to the You in advance.
10.2. Refund Process
10.2.1. Eligible refund requests will be processed by CRCC Asia in coordination with the relevant Program Provider within forty-five (45) business days from the date of receipt of the written cancellation or withdrawal request.
10.2.2. Refunds shall be issued via the same payment method used by You unless an alternative method is provided.
10.2.3. In instances where payments are made through a University or Service Provider, refund processing will be handled by the respective entity in coordination with CRCC Asia, and CRCC Asia shall not be liable for any delays or discrepancies arising from third-party payment processing.
10.3. Force Majeure Cancellations.
10.3.1. CRCC Asia shall not be responsible or liable for changes or cancellations to its Program under any of the following circumstances, to wit: war or threat of war, terrorism or threat of terrorism, civil strife, riot, industrial dispute, lock closure, natural or nuclear disaster, chemical or biological disaster, adverse weather, sea, ice and river conditions, fire, sickness, environmental or climate concerns, acts of government or local authority, or any other event or circumstance which amounts to a “Force Majeure” and in such cases no refund or compensation for any loss will be given to You or the Program Provider unless otherwise determined in CRCC Asia's sole discretion.
10.3.2. Advice from the UK Foreign Office to avoid all but essential travel, a Level 4 US State Department warning, or a Level 3 Warning from the CDC will constitute Force Majeure. For the avoidance of doubt, a Force Majeure event will not affect the abovementioned Refund Eligibility. Thus, if a Program is cancelled due to a Force Majeure event, CRCC Asia will, wherever possible, attempt to arrange a suitable alternative Program for You and/or the Program Provider.
11. Third-Party Providers and Information Accuracy
11.1. Accuracy of Program Materials
11.1.1. CRCC endeavors to provide accurate, up-to-date information on its website, in promotional materials, and within welcome letters and pre-departure resources. However, inadvertent errors or omissions may occur, and CRCC shall not be held liable for any misstatements, ambiguities, or inconsistencies that may appear in these materials.
11.1.2. In the event of any discrepancy or conflict between these materials and that of CRCC’s Terms and Conditions or your designated final program itinerary, the Terms and Conditions and your final program itinerary shall take precedence.
11.2. Third-Party Suppliers; Changes to Program; and Responsibility
11.2.1. CRCC will make reasonable efforts to identify quality suppliers, where applicable to the Program, of accommodations, food, transport, travel, tours, recreational or athletic activities, service learning/experiential learning sites, academic/educational activities, and other goods and services related to the Program (“Suppliers”). You understand and acknowledge that CRCC does not represent or act as an agent for, and cannot control the acts or omissions of, any Program Suppliers.
11.2.2. You agree that CRCC may, in its sole discretion, make any change in any part of the Program it deems necessary. You understand and acknowledge that CRCC is not responsible for any disruption in travel arrangements, or any consequent additional expenses that may be incurred therefrom, including lost baggage.
11.2.3. CRCC may substitute accommodations or housing of a similar category at any time.
11.2.4. You agree that CRCC is not responsible for any injury Participant may suffer while traveling independently before, during or after the Program.
12. Data Protection and Data Sharing
12.1. You agree that we may collect and process Your personal data in accordance with the terms set out in our Privacy Policy.
12.2. You agree that we are the data controller and our instructed suppliers (including Host Companies and visa processing agents, travel agents, accommodation providers and universities) are the data processors in respect of any personal data you may provide to Us in connection with Your Program.
12.3. Our suppliers shall only process the personal data in accordance with our instructions from time to time and shall not process the personal data for any purposes other than those expressly authorized by us.
12.4. During your program we may undertake activities to collect material, including but not limited to photographs, videos, oral and written testimonials.
By participating in a CRCC Asia program, you grant CRCC Asia a perpetual, worldwide, royalty-free, non-exclusive license to collect, use, reproduce, distribute, and publish the abovementioned media content captured, taken, or submitted during your program experience.
12.5. This content may be utilized for promotional, educational, and reporting purposes across a variety of platforms, including but not limited to websites, social media channels, brochures, presentations, advertisements, and other marketing materials.CRCC Asia respects your privacy and adheres to applicable data protection regulations. Any media content shared will be used responsibly and in a manner that maintains the integrity and dignity of program participants. Your personal data, including identifiable media, will not be shared with third parties beyond CRCC Asia’s promotional and operational needs.Media content and personal data will not be sold, rented, or otherwise disclosed to unauthorized third parties. In specific circumstances, your data may be disclosed if:• Required by applicable law or regulation;• Necessary to protect your vital interests in case of an emergency; or• You provide explicit and informed consent for such use.
Unless otherwise withdrawn by you, your media content may be retained and used for a period consistent with CRCC Asia’s operational and promotional needs, after which it may be archived for historical or reporting purposes. CRCC Asia will review its usage periodically to ensure compliance with data protection principles.
12.6. Right to Withdraw Consent
You have the right to withdraw your consent for the use of your media content at any time. To exercise this right, please submit a written request to CRCC Asia via email at dataprivacy@crccasia.com.Upon receipt of your request:
12.6.1. CRCC Asia will cease the use of your media content in all future materials as soon as reasonably practicable. This includes the removal of your content from unpublished marketing campaigns and other upcoming promotional materials.
12.6.2. While CRCC Asia will make reasonable efforts to address your request, please note the following limitations:
a. Previously Distributed Materials: Media content already incorporated in printed brochures, collaborative campaigns, or similar materials that have been distributed cannot be recalled or modified.
b. Third-Party Platforms: Media content shared on public platforms (e.g., social media) may have been reposted, shared, or embedded by third parties, which may prevent full removal.
13. Health, Safety, and Medical Responsibility
13.1. Health and Safety Information; Duty to Investigate
13.1.1. You acknowledge that You have read and understood the health and safety information provided in the application materials, as well as the health and safety information concerning travel to the Program location, including current terrorist warnings, travel advisories and health advisories, provided by the US Department of Homeland Security (DHS) (http://www.dhs.gov/dhspublic), the U.S. Department of State (DOS) (http://www.state.gov), and the US Centers for Disease Control (CDC) (http://www.cdc.gov) (collectively the “Health and Safety Information”). You further understand and agree that if you would like to inquire about or have concerns regarding the health and safety conditions associated with any particular country, area, environment, service, transport, carrier or activity, as well as any medical issues (such as immunization), CRCC, upon Your request, will refer You to third parties such as governmental agencies or professional organizations in the Program’s home country(ies) or the Program’s host community(ies).
13.1.2. You understand that You are responsible for investigating and evaluating the health and safety risks that You may face, including but not limited to inherent risks. This responsibility includes, but is not limited to, the responsibility for (1) reviewing the Health and Safety Information for periodic updates, and (2) consulting with a physician or appropriate specialist for advice on the risks in the Program-related travel and recommendations for appropriate precautions for Participant. You further agree that it is Your responsibility to take the precautions recommended by the DHS, DOS, and CDC to minimize health risks, including, in the case of insect-borne disease (e.g. Zika), wearing protective clothing and applying proper insect repellant when You will be outdoors.
13.2. Medical Conditions; Medication
13.2.1. You agree to report to the CRCC local office coordinating Your Program any physical or mental condition You have, which may require special medical attention or accommodation during the Program as early as possible, but no later than sixty (60) days prior to the Program start date. You specifically understand and agree that we cannot be held responsible for any consequences arising from pre-existing medical, emotional or other conditions and dispositions, including but not limited to ailments, trauma, depression, eating disorders or dietary habits.
13.2.2. We will use reasonable efforts to accommodate physical or mental conditions you have disclosed to us in a timely manner, including suggesting alternative programs or program locations which may better suit your needs.
13.2.3. If You did not give us full details of any physical or mental conditions that You are aware of prior to Your Program Start Date or any physical or mental conditions that You become aware of during Your Program, we may, at our sole discretion, cancel Your Program and impose applicable cancellation charges.
13.2.4. You understand and agree that if You will need any medications during the Program it is Your responsibility to bring an adequate supply of these medications. You understand that some medications may not be available in some countries of destination, and that it may not be possible to promptly receive these medications by mail.
14. Travel Outside the Program Location
14.1. Travel Notification.
Any travel undertaken by You outside the designated Program location, whether for personal reasons or in connection with work or Host Company activities, must be declared to CRCC Asia in advance through submission of a travel plan in the form prescribed by CRCC Asia. You acknowledge that submission of a travel plan is a mandatory requirement and that failure to do so may result in disciplinary action, program delay, or other consequences at CRCC Asia’s discretion.
14.2. Applicable Travel Waivers
By submitting a travel plan, You acknowledge and agree that You will be required to review and accept the applicable travel waiver(s), as determined by the nature of the travel:
14.2.1. Personal Travel Waiver: Where the travel is undertaken for personal, leisure, or non-program purposes, the Personal / In-Country or Overseas Travel Waiver shall apply.
14.2.2. Work-Related Travel Waiver: Where the travel is undertaken in connection with Host Company activities, off-site work, business trips, or any work-related engagement outside the Program location, the Work-Related Travel Waiver shall apply.
The full terms of the applicable waivers form an integral part of these Terms and Conditions and are incorporated by reference.
14.3. Scope of Responsibility During Travel
You acknowledge and agree that:
14.3.1. CRCC Asia’s duty of care and on-site support are limited to activities conducted within the designated Program location and during scheduled Program activities.
14.3.2. Any travel outside the Program location, including travel not directly supervised by CRCC Asia staff or Program Managers, is undertaken at Your own discretion and risk, even where such travel is related to work or Host Company activities.
14.3.3. CRCC Asia will provide assistance only in emergency situations and only to the extent reasonably practicable, and does not assume responsibility for travel arrangements, accommodation, transportation, or expenses incurred during such travel.
14.4. You confirm that You have read, understood, and agreed to the risks, responsibilities, release of liability, and indemnification obligations set out in the applicable travel waiver(s), including but not limited to risks arising from:
● travel conditions and transportation
● accommodation arrangements
● health, safety, political, and environmental factors
● activities undertaken at the travel destination
You expressly agree that CRCC Asia, its employees, agents, officers, and representatives shall not be liable for any loss, injury, damage, or expense arising from or connected with such travel, as further detailed in the applicable waiver(s).
15. Voluntary Assumption of Risks
You understand that Your participation in the Program is wholly voluntary. Although CRCC has made every reasonable effort to assure Participant’s health and safety while participating in the Program, there are unavoidable hazards and risks inherent in travel to and from the Program location and the activities included in the Program, including but not limited to those described in the Health and Safety Information and those associated with:
15.1. Foreign political, social and economic conditions which are different than Participant’s home country and which can change in an unpredictable manner;
15.2. Different standards of design, safety and maintenance of buildings, computing facilities, public spaces and transportation;
15.3. Varying quality of available medical treatment and differing health, safety, legal, cultural and religious beliefs and conditions;
15.4. War, terrorism, crime, civil unrest, kidnapping, illness, public health risks, accidents, acts of God and/or violence; and
15.5. Other possibly dangerous conditions beyond the control of CRCC, all of which could cause serious personal injury or loss of life to Participant and/or loss or damage to Participant’s property overseas. You are aware of and understand the foregoing hazards and risks and You hereby assume, knowingly and voluntarily, each of the risks described above and all of the other risks which could arise out of or occur during Participant’s travel to, from, in or around the Program location.
16. Release and Indemnification
You, individually and on behalf of Your heirs, successors, assigns and personal representatives, hereby release and forever discharge CRCC, its employees, agents, officers, directors, and representatives (in their official and individual capacities) (the “CRCC Representatives”) from any and all liability whatsoever for any and all damages, losses or injuries (including death) Participant sustains to Participant’s person or property or both (“Losses”), including but not limited to any claims, demands, actions, causes of action, judgments, damages, expenses and costs, including attorney’s fees, which arise out of, result from, occur during or are connected in any manner with Participant’s participation in the Program, any related or independent travel, or any activities or excursions, irrespective of whether they are sponsored, supervised or controlled by the CRCC Representatives, except for such Losses as may be caused by the gross negligence or willful misconduct of the CRCC Representatives. You also agree to indemnify and hold harmless the CRCC Representatives from and against any Losses.
17. Limitations on Liability
17.1. Notwithstanding anything in this Agreement to the contrary, our aggregate maximum liability to you is limited to the amount of actual cash paid by You to Us for Your Program.
17.2. It is a condition of our acceptance of any liability under this Agreement that You promptly notify any claim in writing to us and/or our supplier(s).
17.3. Where any payment is made, the person(s) receiving it must also assign to ourselves or our insurers any rights they may have to pursue any third party and must provide ourselves and our insurers with all assistance we may reasonably require.
17.4. Under no circumstances shall we be responsible for Losses arising at any third-party location including but not limited to the premises of the assigned internship Host Organization or the designated accommodation.
18. Special Requests
Any special requests must be advised to us at the time of enrollment (e.g. diet, room location, etc.). You should then confirm Your request(s) in writing. While every reasonable effort will be made by us to accommodate Your reasonable special requests, we cannot guarantee that they will be fulfilled. The fact that a special request has been noted on Your confirmation email or any other documentation or that it has been passed on to the accommodation or other supplier is not confirmation that the request will be met. We do not accept enrollments that are conditional upon any special request being met.
19. Confidentiality
You acknowledge that data, know-how, trade secrets, client or supplier lists, personnel information, financial and business information of Your Host Company, and any information designated by Your Host Company as being “confidential”, is Confidential Information of Host. You agree not to disclose Confidential Information to any third party and must not use Confidential Information in any way other than for the purposes of Your work experience with Your Host Company. If You wish to include Confidential Information in any reports, presentations or other materials created to meet the assessment requirements of any course of study, You will first obtain the permission of Your Host Company.You acknowledge that Your Host Company may require You to enter into a separate non-disclosure or confidentiality agreement as a condition of Your Placement. You agree to execute any such agreement as reasonably required and to comply fully with its terms. Any obligations imposed under such agreement shall be in addition to, and not in limitation of, Your confidentiality obligations under this Agreement.
20. Notices
All notices under this Agreement must be in writing and may be sent by prepaid international courier (e.g. DHL, FedEx, Aramex) or electronic mail to the addresses set forth herein.
21. General
This Agreement represents the complete understanding with CRCC concerning CRCC’s responsibility and liability for Participant’s participation in the Program. This Agreement supersedes any previous or contemporaneous understandings with CRCC, whether written or oral and cannot be changed or amended except in writing and signed by an authorized officer or agent of CRCC. This Agreement may be executed in one or more counterparts. Should any provision or aspect of this Agreement be found unenforceable, all remaining provisions of the Agreement will remain in full force and effect. Should there be any dispute concerning Participant’s participation in the Program that would require the adjudication of a court of law, such dispute or lawsuit must be settled by arbitration in Hong Kong under the Hong Kong International Arbitration Centre Administered Arbitration Rules, when the Notice of Arbitration is submitted in accordance with these Rule. This Agreement shall be governed by the laws of Hong Kong.
